General Terms and Conditions

Ticket terms and conditions

Please read these Terms & Conditions carefully before purchasing tickets or attending a Matamata Racing Club event. By purchasing tickets or attending an event oncourse, you are agreeing to be bound by the following Terms & Conditions.

1.0 Definitions

MRC means Matamata Racing Club Inc.

Tickets and Hospitality Packages means admission tickets to public areas, racecourse stands, and / or specified hospitality areas with defined hospitality packages, or such other rooms, events or products provided by MRC at a Venue.

Venue means Matamata Racecourse.

2.0 Agreement

2.1 Bookings are subject to the availability of the requested hospitality area and will not be reserved or confirmed until online purchase and full payment is received in accordance with these Terms & Conditions.

2.2 Tickets and Hospitality Packages are non-refundable once purchased, subject to these Terms & Conditions and any obligations MRC owes to any consumer under applicable consumer law.

3.0 Payment

3.1 All bookings for Tickets and Hospitality Packages must be accompanied by full payment in the form of direct credit or by credit card.

3.2 GST will apply to all goods and services supplied where applicable. Prices are in New Zealand dollars and include GST unless otherwise stated.

3.3 All Ticket and Hospitality Packages must be consumed within the timeframe as stipulated by MRC.

(a) Packages inclusive of beverages – MRC accepts no responsibility for late arrivals and the package duration may not be extended beyond the stipulated time under any circumstances. You must provide credit card details or cash for payment of beverages consumed past that time.

(b) Packages not inclusive of beverages – You must provide cash, EFTPOS or credit card details for payment of beverages when purchased.

4.0 Health and Safety

4.1 The Health and Safety at Work Act 2015 requires visitors to take reasonable care that their actions (or lack of action) do not put themselves or others at risk and to follow any reasonable health and safety instructions given to them by MRC.

4.2 Be aware that horses are a hazard on site during racedays. Horses can be aggressive, they can kick out, stand on you and bite. Always be watchful where horses are present. Follow all instructions given by MRC personnel when moving in areas where horses may be present. Stay away from unauthorised access areas unless authorised to do so.

5.0 Use of facilities

5.1 The serving and consumption of alcohol is subject to liquor licensing laws including the Sale and Supply of Alcohol Act 2012 and its requirements. The management and staff of MRC believe that they have a responsibility to provide an environment that is not only comfortable and welcoming but is also where alcohol is served responsibly. With that in mind, the MRC Host Responsibility Policy has been implemented and applies to all events held at the Venue.

5.2 The Venue is a fully licensed venue. “BYO” alcohol is not permitted in any areas.

5.3 A dress code may apply to hospitality areas and events oncourse and is enforced. Anyone not adhering to the dress code will not be permitted to enter hospitality areas/events.

5.4 Promotional photographs and film footage is taken on racedays and at racing events. By entering the Venue, you consent to the use of your image by MRC and New Zealand Thoroughbred Racing for promotional purposes.

6.0 Facility signage

6.1 No branding or signage is permitted in any general or shared room facility.

7.0 Issue of tickets

7.1 All tickets are e-tickets, meaning you can print at home when suits. Alternatively, you can show your ticket on the day via your phone provided your screen is in good condition.

7.2 The issue of tickets to a particular facility does not permit entry to any other private facility. However, you may access and utilise public areas.

7.3 MRC will not accept responsibility for misplaced, lost or stolen tickets previously issued. Any replacement tickets will be issued at the sole discretion of the MRC, and MRC reserves the right to charge for the replacement of any tickets issued.

8.0 Display of tickets

8.1 Correct ticketing must be displayed at all times and/or on request. Failure to comply will result in entry being refused or removal from the Venue.

9.0 On selling

9.1 You may not on-sell your ticket. Tickets found to be on-sold will be cancelled.

10.0 Conditions of entry

10.1 MRC has the right to deny entry into, or remove ticket holders from, a raceday where MRC has reasonable grounds to do so, including any breach of these Terms & Conditions, including, but not limited to, intoxication, being under the influence of illicit drugs, being inappropriately attired or deemed by management to be adversely affecting the enjoyment of the raceday by others.

10.2 You may be required to consent to a search of your person and/or possessions before entering the Raceday, and an identification check at any time. Any refusal may see you refused entry to the Venue, or any facility or area within the Venue, or may require you to leave the Venue. No refund of any part of any ticketed event or activity will apply.

10.3 Entry to the Raceday may be refused if the authenticity or validity of a ticket is questionable, including because the ticket has been damaged or defaced in any way, or has not been purchased from MRC directly.

11.0 Alterations to the Raceday

11.1 Some hospitality areas are outdoors. In such cases, no alternative facilities are available in the event of unfavourable weather in some instances.

11.2 If any part of the Raceday including, without limitation, a race meeting, any race, performance or event is cancelled, abandoned or postponed, in whole or in part, due to adverse weather or for any other reason whatsoever that is beyond MRC’s control, there is no right to refund or exchange and no obligation is assumed by MRC for the arrangement of a substitute event, performance or any other element.

11.3 Due to unforeseen circumstances it may be necessary for MRC to reschedule the Raceday and, if MRC does so, MRC will use its reasonable endeavours to provide you with a comparable facility on the rescheduled day. If MRC does provide a comparable facility on the rescheduled day MRC is not liable to refund your ticket price.

11.4 Programmes, menus and the duration and timing of performances, events and other activities at the Raceday may be subject to alteration without notice. MRC reserves the right to vary, add, withdraw or substitute advertised programmes, menus, seating arrangements and/or facilities at any time.

11.5 Under no circumstances will MRC be liable to you if MRC is unable to perform its obligations under these Terms & Conditions due to any event or cause beyond the reasonable control of MRC.

12.0 Covid-19

12.1 You agree that your information may be held by MRC for the purposes of COVID-19 contact tracing and may be disclosed to the Ministry of Health should the need arise. By purchasing Tickets and Hospitality Packages and attending a Raceday at a Venue, you agree to comply with:

(a) any COVID-19 conditions of entry for the Venue in place from time to time;

(b) any reasonable request from MRC to undertake contact tracing at the Venue; and

(c) any Government or local government notice, regulation, law or guidance in connection with contact tracing or other public health requirements.

12.2 If the Raceday cannot be held as planned on the originally scheduled date due to a pandemic or epidemic event, including COVID-19 and including as a result of a Government notice, regulation, law or guidance affecting the operation of the Raceday, limiting the number of attendees at Raceday, or affecting the operation of any event, performance, or other activities at the Raceday, then MRC will use its best efforts to reschedule the Raceday and all tickets will be transferred to the rescheduled date. If MRC cannot reschedule the Raceday then MRC will cancel the Raceday, and you will be entitled to a refund of the ticket price you have paid for the ticket(s) less booking fee and any reasonable costs incurred by the Operator in connection with the Raceday Event which the Operator cannot recover.

12.3 The Operator will not be liable for any delay or failure or inability to observe or perform any of its duties or obligations under these Terms & Conditions if that delay or failure arises from a pandemic or epidemic event, including COVID-19 and including as a result of a Government notice, regulation, law or guidance affecting the operation of the Raceday.

13.0 General

13.1 All representations and warranties, whether expressed or implied are excluded to the maximum extent permitted by law. Nothing in these Terms & Conditions affects a Client’s rights under applicable consumer law, to the extent that the Client is a consumer for the purposes of the Consumer Guarantees Act.

13.2 These Terms & Conditions are governed by New Zealand law and the parties agree to submit to the exclusive jurisdiction of the courts of New Zealand.

13.3 MRC may collect personal information from you, and if it does so, it will collect and store that information in accordance with the MRC Privacy Policy available on the MRC website. Contact details provided when purchasing Tickets and Hospitality Packages can be used by MRC and provided to New Zealand Thoroughbred Racing for promotional, marketing and research purposes.

14.0 Non-Raceday events and tickets

14.1 All events booked through the MRC Ticket Store for events that do not occur on a Raceday are governed by their own set of Terms and Conditions. Please refer to individual event pages for full terms of these events.
